Gomry Ads - Terms of Service
These Terms of Service (“Terms”) and Advertising Standards (“Standards”) govern your access to and use of Gomry Ads (the “Service”), including any advertisements you submit, purchase, manage, or deliver through Gomry’s properties and partner inventory (collectively, the “Gomry Inventory”). By creating an ad account, submitting an ad, or spending on the Service, you agree to these Terms and Standards.
If you accept on behalf of a company, you represent that you have authority to bind that company. Product-specific terms may also apply.
A) Terms of Service
1) Definitions
Advertiser – The brand, company, or individual purchasing or submitting ads (e.g., a sponsor).
Publisher – The event organizer or entity that owns the inventory where ads are displayed (e.g., an event page on Gomry).
Ad – Any creative, copy, landing page, tracking tag, file, or instruction submitted for delivery.
Campaign Data – Settings, budgets, bids, targeting selections, and performance metrics.
Gomry Inventory – Ad placements across the Gomry ecosystem (e.g., publisher event pages, ticket flows, emails, notifications, feeds) and any approved partner placements.
Policies – These Standards and any guidelines Gomry publishes from time to time.
2) Eligibility & Accounts
You must provide accurate information and safeguard your credentials. Gomry may require verification, documentation, or pre-approval for certain categories or regions.
3) Review and Delivery – No Guarantee
All ads are subject to review and may be rejected, removed, or restricted at any time, whether or not they initially passed review. Delivery, performance, placement, reach, or results are not guaranteed. Metrics are estimates and may filter invalid activity.
4) Pricing, Billing, and Taxes
You authorize Gomry to charge your chosen payment method for all spend, fees, and applicable taxes.
All ad spend is non-refundable and all sales are final, except where required by law. Gomry may grant courtesy credits at its sole discretion; credits are not cash, may expire, and may be revoked.
You are responsible for all taxes, duties, or regulatory charges arising from your ads.
5) Advertiser Obligations & Warranties
You represent and warrant that:
You own or hold all necessary rights to the ad and landing-page content, trademarks, and any data you provide.
Your ads and targeting comply with all applicable laws and regulations wherever the ads may appear.
You will not include malware, spyware, hidden code, or attempts to bypass review, measurement, or enforcement.
You will provide clear, accurate disclosures and honor all promises in your ads and landing pages.
5A) Publisher Obligations & Warranties
Publishers agree to:
Provide a brand-safe environment and not modify, misplace, or obscure ads.
Ensure their events and content comply with these Standards, Gomry Policies, and all applicable laws.
Promptly remove or disable ads at Gomry’s or the Advertiser’s request when required.
Not generate invalid traffic, clicks, or impressions, nor incentivize deceptive engagement.
6) Targeting & Data Use
Do not use sensitive personal data (health, race, ethnicity, religion, sexual orientation, union membership, political opinions, biometric or precise location) for targeting or measurement.
Audience lists must be lawfully obtained with proper consent and a clear opt-out; remove users who opt out.
Use Campaign Data solely to manage campaigns on Gomry, not to build or enrich third-party profiles.
7) Prohibited Practices
You agree not to: (a) run misleading, deceptive, harmful, or unsafe ads; (b) engage in click-bait or engagement bait; (c) spam users; (d) misstate the nature, price, or terms of an offer; (e) imitate Gomry UI or misrepresent affiliation with Gomry; (f) resell inventory without consent; (g) encourage illegal activity.
8) Enforcement
Gomry may, with or without notice, take any action deemed necessary to protect users and the platform, including rejecting or removing ads, restricting targeting, limiting spend, suspending or terminating accounts, and reporting illegal activity. Severe or repeat violations may result in permanent bans across Gomry Inventory.
9) Intellectual Property
You grant Gomry a worldwide, non-exclusive, royalty-free license to host, copy, modify, and deliver your ads for the purpose of providing the Service. Use Gomry brand assets only as permitted by our Brand Guidelines.
10) Confidentiality
Non-public aspects of the Service (e.g., review tools, detection systems) are Gomry confidential information. You will not reverse-engineer, publicly benchmark, or disclose them.
11) Disclaimers & Limitation of Liability
The Service is provided “as is.” To the fullest extent permitted by law, Gomry disclaims all warranties and is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Gomry’s aggregate liability is capped at the amount you paid for ads in the three (3) months preceding the claim.
12) Indemnification
You will indemnify and hold harmless Gomry and its affiliates from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your ads, content, targeting, data, or breach of these Terms.
13) Modifications & Suspension
Gomry may modify these Terms or the Standards at any time. Material changes will be posted and take effect upon posting unless otherwise noted. The Service may be suspended for maintenance, security, or legal reasons.
14) Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. You and Gomry submit to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware for any dispute arising out of or relating to the Service, unless consumer law requires a different venue.
15) Miscellaneous
These Terms constitute the entire agreement for Gomry Ads. If any provision is unenforceable, the remainder remains in effect. You may not assign these Terms without Gomry’s consent; Gomry may assign to an affiliate or in connection with a merger or sale. No waiver is implied by inaction.
B) Gomry Advertising Standards
These Standards apply to all ads on Gomry Inventory. Where conflict exists, the stricter rule (law or policy) prevails. Examples below are illustrative, not exhaustive.
1) Creative Quality & Relevance
Ads must be truthful, accurate, and clearly identify the product, service, or event.
Use proper grammar, working links, high-quality images. Avoid excessive symbols, capitalization, or shocking content.
Landing pages must match the ad and function on common devices without unexpected downloads, pop-unders, or excessive interstitials.
No fake UI elements (“system alerts,” “you have a message”).
2) Prohibited Content
Always blocked:
Illegal products or services.
Discriminatory content or hate speech.
Explicit sexual content, escort services, sexual-enhancement products.
Tobacco and related products, including vapes.
Recreational drugs and paraphernalia.
Weapons, explosives, or instructions to build/procure them.
Misleading health claims, miracle cures, before/after weight-loss images.
Deceptive financial schemes, get-rich-quick offers, MLMs, payday loans.
Malware, spyware, hidden mining, surreptitious data collection.
Counterfeit goods or unauthorized sale of copyrighted content.
Deepfakes/synthetic media that mislead or are not clearly disclosed.
Political or issue ads – not accepted at this time.
3) Restricted Content
Allowed only with strict conditions and compliance with local law:
Alcohol (age-gating and responsible messaging).
Gambling and games of chance (licensing, age-gating, jurisdiction).
Pharmaceuticals/medical devices (prior authorization, disclosures).
Financial services (banking, investment, credit, insurance, BNPL, crypto) with clear risk disclosures, licensing, no targeting of minors or vulnerable groups.
Dating services (18+, clear subscription terms).
Supplements (no unsubstantiated claims).
Weight-loss products (18+, no unrealistic results or body-shaming).
4) Targeting & Minors
Do not target minors with personalized advertising.
Do not exploit sensitive categories (health, race, etc.) or precise location without lawful basis.
Implement required age-gating for restricted categories.
5) Spam, Misleading, and Manipulative Practices
No chain messages, mass unsolicited DMs, deceptive redirects.
Engagement bait (“Like to win,” “Share to unlock”) allowed only if permitted by promotion rules.
Promotions must include official rules, eligibility, start/end dates, and clearly identify the promoter.
6) Brand Safety & Sensitivity
Gomry may restrict placements near sensitive content or events to protect brand safety and user experience.
7) Claims, Testimonials, & Disclosures
Objective claims must be substantiated; comparative claims must be verifiable.
Provide clear, prominent disclosures for prices, fees, auto-renewals, and sponsored content.
Influencer/creator ads must include a conspicuous paid partnership disclosure.
8) Technical & Tracking Requirements
Tags, pixels, and SDKs must be secure, performant, and privacy-compliant.
Do not collect sensitive data or track users without proper notice and consent.
Do not attempt to bypass Gomry’s measurement or fraud-prevention systems.
9) Review, Appeals, & Recourse
If your ad is rejected or removed, you may appeal via the Help Center or info@gomry.com. Provide the ad ID, reason for appeal, and supporting materials.
10) Enforcement Actions
Violations may trigger warnings, limited delivery, removal, spend caps, suspensions, or account termination. Severe or repeat violations may result in permanent bans and forfeiture of credits.
11) Reporting Abuse
Report suspicious ads or policy violations to info@gomry.com. Gomry investigates and acts as appropriate.
